Abstract: The protection of individuals with regard to the processing of personal data is a fundamental right which, as such, deserves the broadest protection of the legal system. In health matters, even more, the guarantee of this protection assumes primary importance considering the sensitive data object of the treatment. Beyond that, in a supranational context it is of fundamental importance that the circulation of such data is regulated with a view to a balance between protection of personal data, freedom of circulation and protection of health. Here is the new European Regulation for the protection of personal data that repeals Directive 95/46/EC and introduces new figures and new security measures to ensure compliance with fundamental principles and rights in this area.
